Legal Question in Family Law in Georgia

Help

I am 18 and daughter is eight months old. her father signed the birth certificate but she has my last name. Now the father never bought anything while I was pregnant, and,he barely buys anything for her now because his father told him because she does not have his last name he should not have to. Is this correct or should he have to provide for her? And also he always says that he and his father are going to take me to court for the last name and they're going to take her because the last name is not the same, Is that possible?

Re: Help

He cannot take your child on the basis that the child does not have his (the putative father) last name. He can petition a court to "legitimate" the child, which is a legal action that establishes the legal relationship between he and the child. He is obligated to pay child support, but to establish the amount and the ability to garnish his wages to get the support, you can file a paternity action against him. You can also call child support enforcement to get a case started. Lastly, if you are in Cobb County, you can call the Cobb Justice Foundation http://www.cobbjustice.org/ and get an attorney if you qualify. They have a community of attorneys who can help on a pro bono basis.
