Legal Question in Family Law in Georgia

I have a baby with a man who I am married to and we were living together. I have left him and I do not want any contact with him but he wants to keep the baby and keep exchanging the baby back and forth between us. I tried to leave with the baby a few times and he would not let me. I called the police and they said that we have the "same rights" and I could not take the baby with me unless my boyfriend agreed. so the baby ended up staying with my boyfriend and I left. Now I want to keep my baby with me full time and do not want to keep trading the baby back and forth. What rights do I have here in the state of GA? I am a nanny and can take my baby to work with me every day. He, on the other hand is jobless, and cannot provide anything for the baby. thank you.

Unless he legitimated the child and has a custody order, he has NO rights to the child, and the police officer who gave you completely wrong information should be reported to his supoerior for discipline. Go get your child and go see a lawyer, today.
