Can My Chidren Be adopted by My new Husband

My kids natural Father has abanded them no chidsupport in about 4 yrs. No phone calls or any kind of contact to kids in 2years.

Can His legal rights be tooken from him.

And can my husband adopt the kids & give them his name He has been here for them for 5 years.

Yes, normally a new spouse can do what is called a step-parent adoption. The biological father has certain rights and he is nornally required to sign a waiver releasing his rights. Once the biological father waives his rights the new parent can then adopt the child. This is a simple answer, and there are other factors involved. If the biological father is not wiling to give up his rights, there are other more complicated ways to have his rights terminated.
