Child custody visitation

Ex-husband has primary physical custody and I have visitation rights. under a joint legal custody agreement. His new wife had him arrested for battery - assault, but has not pressed charges yet. She is planning on divorcing him for physical and verbal abuse. What are the possibilities of changing the custody agrement to request primary custody of my son using this evidence (DA's report)?
