Child Support Arrears & Incarseration

My x-husband was incarserated in for child abuse. I just found out he got out 2 yrs ago and then contacted child support svcs to start the process of payments. My x is now saying he can't pay the arrears ($60k)or even the monthly payments now-but hired a lawyer to help him? Does he owe for the 4 yrs he was incarserated? Also, I have full custody of the children..If he files for visitation, will a judge grant visitation even though he was found guilty to child abuse?

The child support for the time that he was in prison might be excused but he is obligated to pay the balance. You should file a motion to reduce his arrears to a judgment so that you will have a lien for what he owes.

As for visition, a judge will be very

reluctant to allow him to have contact with the children.
