child support

I have a son who is 3 months old, I am 17, his father is 22 I got pregnant when i was 15 and he was 21. Could he be charged with statutory rape?

Also, does he have more rights to the baby than i do?

He certainly could be charged with statory rape. The code of Ga provides: "(a) A person commits the offense of statutory rape when he or she engages in sexual intercourse with any person under the age of 16 years and not his or her spouse,"

In Georgia, the father of a child born out of wedlock does not have any legal rights to the child until he goes to court to legitimate the child. He has no right to visit the child until he files an action for legitimation and visitation. You are the only parent with rights to your child at this point regardless of whether his name is on the birth certificate, he pays child support, or has established paternity.
