What right do I have as a seperated custodial parent? How do I go about a legal seperation.

Basically, you file for Separate Maintence just like you would for divorce. Then, you have the same rights as might be granted in the case of divorce. I would strongly advise that you consult with a local attorney before undertaking this on by yourself. Unlike small claims court, the superior court does not provide forms. You, or an attorney, needs to file the documents from scratch and they must be correct or you run the risk of having your case thrown out.
