trying to get custody of my younger sister

I am trying to get custody of my younger sister. Her mom threw a telephone at her and kicked her out with nothing but the clothes on her back about 2 and a half months ago. Her mom was abusing her because she dates black people so she called me to come and get her so she could live with me . Her mom told her she could leave and I have in it my computer that she said it. Will that help me getting her? She is 16 and will be 17 this september. My sister wants to keep staying with me but her mom said she will force her to come home. What do i need to do to make it to where she can stay with me? If she elects me as her primary custodian can her mom make her come home? Or does she have to have her mother's permission before she can elect me as her primary custodian? Please help me before she has to leave and go back with her mother.

Since you are not the child's parent's and your sister is still a minor she would have to follow her wishes. Further, any interfernce by you with her custdial rights would a crime. If you truely fear for your sister's well being, you could apply to the superior court for an order granting you physical custody of your sister. Without one, you have no power or control over her.
