Legal Question in Family Law in Georgia

divorce pro se

In GA you have to file a Domestic Relations Financial Affidavit and a Verification along with the Complaint for Divorce. I need to know if I have to fill out one for me (plaintiff) AND one for my soon to be ex-husband (defendant). There is a place on the form for either one to sign, but not both on the same sheet.

The form was made for experienced attorneys to use; hence, the lack of instructions. Your are likely to be faced with similar challenges each step of the way, as you try to represent yourself. Recent changes in the child support laws make filing your own affidavit and/or handling your divorce, without hiring an attorney unwise. Furthermore, once the court orders are complete, obtaining modification during the first three years of the support order will be extremely difficult. Having said that, you cannot complete anyone's affidavit other than your own.

It is a horrible and dangerous idea to file any divorce pro se. If you have children, it also is nearly impossible. There is no standard "form" that works any more. Different judges are beginning to require different forms and information. Certain judges are now requesting things for which no form exists, or are requesting attachments that will not be available from the court (or any website).
