Legal Question in Family Law in Georgia

My girlfriend is being harassed by her ex. Repeated late phone calls, threatening to show up at her house. The reason is because they have a son together. They were never married, and never had an official custody battle. She takes care of her son who is 7 and he does not want to see his father, also his father does not pay anything for this child. He has been in and out of jail his whole life, and a few years ago actually held his son hostage until the police arrived. My girlfriend is worried for her and her sons safety. Does she have to have this mans address and social security number to file a restraining order? That was something the local police said she needed. I'm just coming into this relationship with her and learning all of these struggles she goes through on a daily basis. I've told her to save and log every message from this man. With this man being a felon and known drug user it shouldn't be hard to win this battle correct? I just want to legally have the justice system on her side for once. Where do we start?

You start by getting off the computer and consulting with an attorney who will review the facts and most likely file a TRO. Be prepared to pay for a consultation at the very least.

Good luck.

There is no "we." If the mother was concerned and was really worried about her safety, she would have immediately contacted a lawyer to discuss the situation rather than having a new boyfriend post on the internet.

As others said there is no "we." She alone can address this. Unless the father has ever legitimized the child he has no rights to see the child. She will want to sit down with a lawyer and determine what, if anything she should do. She may have both criminal and civil remedies which may include criminal warrants, TPOs and other relief.
