Is it legal to act as a private detective for yourself to obtain proof that children are NOT residing in custodial parents home? Without harrassing or threating anyone or being around the children. We can't afford the cost of a private detective.The custodial parent had custody of two children and has never in the two years took them to his residence for more than a night. The visiting parent has never once picked up or dropped children off at the custodial parent's home. The custodial parent has remarried and has 3 new stepchildren but has not included the biological children. The visiting parent wants to get custody of children who lost custody due to pregnancy during separation before actual legal separation was filed. The pregnancy was pulled in after and against her. Doctor's records show when she first found out about pregnancy and records also show where the couple lived together again as man and wife before divorce was finalized; him promising to let her have the children back if she came home. He even signed the birth certificate as the eligetiment child's father.Then they split up again and the divorce was final.

Don't that void the divorce proceedings? Thank you for any help you can give.

Acting as a PI is neither legal nor illegal; it depends on your individual actions. Of course, you cannot perform PI services for someone else without a license. I'm not sure I understand your second question.
