Legal Guardianship

Is it possible to gain legal guardianship of a 17 year old by the biological father, who is not however listed on the birthcertificate but has proven paternity - and there was no marriage to the mother of that minor.

the child resides with father now; but cannot enroll in high school without guardianship papers, but mother refuses to send any documentation, though she consents to child being here.

what steps can be taken to get guardianship or emancipation so that child can attend school.

A minor child's guardian is usually the parent(s). When a minor is living in a county without a guardian, a temporary guardianship can be petitioned for, by the person the child is living with. The mother needs to be put on notice and can object, but a temporary guardianship, if granted, would probably solve the problem of enrolling the boy in school.
