I live in Georgia.

Can a mother take their son across state lines to texas, without the fathers knowing/consent?

Need to get out of a bad marriage...

Yes, but doing so without legal help is foolish. For six months after that ill-advised stunt, the husband can file suit in Georgia, force you to defend the case there, and may strip you of custody for separating the child from his father. The fact you can do something doesn't change how catastrophic the choice would be, so do NOT do it unless you have already retained counsel and fully assessed the risk in your case.

Legally you can move with the children. Legally the father can go get them and bring them back. Both parents have equal rights until a Judge says otherwise. Most judge's frown on a parent secretly removing the children unless there are extenuating circumstances which left the moving parent no choice. I suggest you meet with a family law attorney to discuss your options and how best to proceed before making such a serious decision.
