Legal Question in Family Law in Georgia

Minors moving in with minors?

What is the legal age for a minor to move in with another minor? For instance: My girlfriend is 15 and I am 16, when could she legally move in with me? I dont mean us having our own house, I mean, her moving in with me and my parents? Please help me. Thank You.

Re: Minors moving in with minors?

Georgia law provides that the parties must be at least 16 years of age to marry. However there are some exceptions to this rule such as the pregnancy of the female. Georgia law also provides that it is illegal to engage in sexual intercourse with any person under the age of 16 years. It is not necessarily illegal for your 15 year old girlfriend to move into your parents house as long as you have the consent of all parties and as long as she is not moving into your parents house for some illegal purpose. The foregoing is general information only, not specific legal advice. No attorney client relationship has been created or implied.

Re: Minors moving in with minors?

Under Georgia law, both you and your girlfriend are subject to the authority of your parents until you reach 18. So, your girlfriend could not legally move in with you now without the consent of both your parents and hers.

Also, the age of consent for a girl in Georgia is 16. If your relationship is an intimate one, you would be guilty of statutory rape, although, since you are less than 3 years older than her, it would be a misdemeanor, not a felony. But, you could not be convicted solely on her unsupported testimony. Also, both your parents should have concern about being charged as accomplices to statutory rape if they knowingly allow you to live together with knowledge that your relationship is intimate.

I would offer, however, that at both your ages it is really too early to be living together. Unless there are some huge problems with her home life, I would strongly recommend that you both focus on your school studies and wait until you both at least graduate from high school before even thinking of living together.
