Legal Question in Family Law in Georgia

possible out-of-state move

I live in metro ATL, as does my ex. I have physical custody of our 2 children. I am remarried and my husband has a job opportunity in FL that he would like to take because his kids live there and he'd get to spend more time with them, plus it's a great offer. It is not specified in my decree that I cannot take my kids out of state. Can my ex stop me from moving? What recourse would he have? I would work with him as much as possible on the transportation. I appreciate any help with this issue.

Re: possible out-of-state move

You can probably move wherever you want, unless the divorce decree says otherwise. Consult with a local attorney.

Re: possible out-of-state move

Your move away may be the basis for your former husband to seek a change of custody or a modification of visitation. The best thing you both could do is to make new arrangements based on the move and embody them in a new agreement and a new court order. Absent such an agreement, the most you may have to do, depending on your agreement/order is to notify him 30 days in advance of the move and your new address and telephone number.

You should consult with a Georgia family law attorney to discuss the specifics.
