Legal Question in Family Law in Georgia

I share legal custody and have sole physical custody. I am planning on moving from GA to FL next year. Do I need a court order from the judge in order to move?

You need to sit down with a lawyer. Even if your papers do not forbid a move, judges do not like a parent moving a child away from the other parent. The other parent may use the move as a grounds to change custody, and for the first six months after the move, you would have to defend that case in the Georgia courts. Additionally, your papers may impose additional requirements as to a move. Finally, you can expect that a judge may possibly make you pay all the costs of transportation for visitation.

It is best to obtain agreement from the other parent, prior to the move. That agreement can be reduced to a court order. Call me to discuss my recommendations regarding how to gain agreement for your move, keeping in mind the best interest of your child. FeLisa Johnson 770-998-3434.
