my son

my son is 14 and his father has custody. he has run away from his fathers house due to the fact that his father hit and choked him and is currently staying with me. he has no desire to go back. can he file assault charges on his father and being that he is 14 can they make him go back?

Any criminal charges would have to be filed in the State where the attack took place.

It would be a good idea for you to file for an emergency order of custody here in Ohio to keep the father from accusing you of interfering with his custody.

You should talk directly to an attorney who does divorce work in your county and get some accurate advice based on all of the facts.
