Spousal Eviction

How do I get my spouse out of my home? She filed for divorce and then dropped the petition. We do not speak, I am going to file for divorce now. She insists on staying in the house; how do I get her out?

Step one is get a lawyer so that what you want MIGHT eventually happen. If you represent yourself, expect things to go wrong. There is no way to tell you if or when you could remove a spouse (or they could remove you). Generally, it will not happen for a good while. A lawyer can best assess your options.

First, get a lawyer. A lawyer can file the divorce and simultaneously get a temporary hearing as quickly as the assigned judge's docket allows. Then, the issue will be decided, at least on a temporary basis.
