Step parent adoption in 7 year old

I have a 7 year old and was never married to his father. He has never payed support or visited him and my husband would like to adopt what do I do. His real father is also in jail. His name was also never put on the birth cert. And he has never claimed my son do I need his permission to have husband adopt.We have been married almost 9 months do I need to wait longer or can he adopt now.

You will need either to get the father's permission or seek to terminate his parental rights. You should consult with a local attorney.

You should have no problems terminating the father's parental rights. If he hasn't legitimated the minor child, this could make the process a bit more easier. Please contact my office for further consultation on this issue.
