my brother is a father who has nothing on him he pays support and ca not talk to his daughter on phone or see her i amam his sister and i made arrangements to see her yesterday she said yes and did not let me see her i have never seen her i just moved here

Your question did not indicate whether your brother has legitimated the child. If he has not, he needs to do so in order to request specific rights of custody and visitation. Until he does, she has ALL of the custodial rights to the child. He should see a family law attorney right away to file a case for this.
