Legal Question in Medical Leave in Georgia

Amount of Time Allowed for Doctor Required Bedrest in Pregnancy and Time-off aft

I have been put on restricted doctor ordered bedrest for the remainder of my pregnancy which totals 10 weeks to the expected delivery date because of preterm labor and preruptured membranes. FMLA reads that a mother is allowed 12 weeks after the birth of a baby. Due to being put on bedrest prior to delivery, I want to ensure that I am still enabled to receive the 12 weeks ''after'' the birth of my baby. I am very concerned. My short term disability reads that it will meet all requirements provided by the FMLA of '93. I understand that I will be able to take the 12 weeks after my son's birth. Am I entitled to my 12 weeks ''after'' the birth of my son?

You are only entitled to a total of 12 weeks for any 12 month period. The 12 can come before or after the birth of the child. You may also be eligible for some other short term disability if you qualify according to the policy. Call me if you have questions.
