Legal Question in Civil Litigation in Georgia

Overcharged for Home Cleaning

I recently moved out of a 3 bedroom

apartment. I called a maid service

to have the place cleaned. Over the

phone she said it would cost $150

minimum and $225 maximum. I

agreed to this and gave her my

credit card number over the phone.

Services were rendered, not 100%

but close enough. However, I

ended up being charged $360 on

my credit card. I called the cleaning

service, and they said they charged

me extra because the apartment

was filthy. I told them that they did

not inform me that they would

charge me extra and I was not

willing to pay over what we had

agreed upon over the phone. The

owner was not willing to cooperate

and hung up on me. So, I refused

the charge on my credit card. Now

the owner of the cleaning service is

calling me demanding the money of

$360 today or I will be sued.

There was no paper work signed,

no invoice, no bills. Everything was

over the phone. They did not inform

me that it would cost extra before

performing the work.

Help!

Re: Overcharged for Home Cleaning

Based on your postings and assuming there was no prior agreement for the extra charge, it is doubtful the company would have a valid claim for the full amount. If they sue, provide the defense that you never agreed to a different amount. Either way, you should offer to pay the real amount to resolve it.
