Legal Question in Civil Litigation in Georgia

Does the plantiff have to pay?

A defendent wins a case in superior court. The court rules defendent has proven case exists for: Fraud, deminished value of a home and punitive damages. Plantiff appeals to GA Court of Appeals and GA Supreme Court (loses both). The case is remittered back to Superior Court for trial. Assuming the plantiff loses and defendent is awarded $$ for fraud, deminished value and Punitive... Does the plantiff have to pay? I hear so much from people saying, ''your biggest issue will be getting him to actually pay.'' Even OJ Simpson has not payed the Brown family the damages awarded in a Civil case.

Re: Does the plantiff have to pay?

The O.J. situation is highly unusual since it involved an NFL pension that was exempt from being attached. Most all other folks who get a judgment against them can have their assets, wages, etc. attached, if they can be located. That usually is the problem: not being able to find anything. For more, the plaintiff should consult with a local attorney.
