Repair mishap

My gas tank was damaged in an automobile accident. The tank was said to be repaired. Picked up the truck, and a couple of days later, smelled gas. Informed the repair shop, and they had no sense of urgency, called on a Wedn. and they wanted the truck on the following Mond. Filled the tank on Thurs. and the tank started to gush gas. My life and my childrens life was in danger. Do I have any legal grounds?

Based on your side of the story, you notified the shop and they agreed to take a look and/or repair. Thet is generally what can be expected.

You make it clear that the car is in a dangerous condition (and I agree it may be). Therefore, you should not make the decision to have your family in the car, if you decided to drive it to the shop or anywhere else.

Your question as asked doesn't make complete sense. Grounds for what?

You certainly have a right to have someone fix the repair you paid for or refund your money.

You don't have any rights to sue for something that didn't happen (in other words, if the botched repair had killed or injured you, you can sue for that, but you can't sue for what did not happen).
