Stolen Debit/ATM card

My card was stolen and used because no business required or ask for identification. Can I take legal action against them for failing to do so?

No.

You are aware, I assume, that there is no liability to you for a stolen credit card as long as you dispute it in writing immediately (do so in 30 days or less via certified mail). You should make a police report and likely will be required to fill in a fraud affidavit for the creditor.
