Suing the Retailer where my stolen credit card was used

I wonder if I can sue Home Depot, who allowed someone else to use my credit card without my consent. The person was one of my employees. Turns out he was arrested for drug possession a year before he made the stolen purchases. I didn't know about this. Does it matter? Should I have known he was arrested for a felony?

I don't think you have a case against Home Depot. They never check my ID when I present my credit card. His history has nothing to do with it.
