Marrying a Brazilian Tourist

My Brazilian girlfriend is coming to the states in one month. She has a tourist visa. We plan to get married. This will be a legitimate marriage. First, should we wait to get married so it doesn't look suspicious to immigration? If so, how long? Second, what does it mean to adjust her status? Third, when we file for her temporary work and travel visas, how long will we have to wait? I am mostly concerned with keeping her legal and not having to send her back to Brazil (financial reasons).

You have a couple of options; you may apply for a spousal visa after marriage or apply for a fiance visa and wait for 90 days before getting married and after she enters the US.

You will want to contact an immigration attorney to fully discuss your situation. As a rough rule of thumb, you will want to wait 90 days. However, there are other matters which you will want to go over first.

If marriage is her intent upon entry, then she may have some problems later on even if she is admitted.

It is taking about 8 weeks to work authorization after applying. After you get married, you need to file full adjustment package. Both of your birth certificates, copies of last 3 years tax returns, etc. will be needed among many other documents. If any of you were married before...divorcee decree from previous marriages are required.
