Legal Question in Insurance Law in Georgia

my car was totalled out in a flood. i owe 8,000 on the vehicle. the kelly blue book value on my car with the mileage is 7,000. insurance only wants to pay 3,300. when i disputed the amount they told me they do not honor blue book value, they look up other cars in the area and the amount that they sell for. when i researched my vehicle i came up with atleast 2 that were valued at 5,000. they would not return my phone calls and they did not return the phone calls from my lein holder. now i received a phone call saying they have tried to leave me several messages and that they spoke with the lein holder and if no paper work is received by the insurance then the lein holder will be forced to process it as a reposession and they will just pay the amount to the lein holder. is there not anything that i can do to get the car payed off or at least get the amount my car is worth?

Next time, buy gap insurance. It's important and would have solved this problem.

If you disagree with the amount, make a complaint to the state insurance commissioner. If you really feel they are wrong sue in Magistrates Court.

Bear in mind that Kelly Blue Book is sometimes inaccurate. Have you checked NADA?
