Legal Question in Insurance Law in Georgia

Disability -am I covered under social security or Teacher Retirement of Ga.

In Georgia, school employees are covered under TRS, not social security. I am vested in both SS and the TRS retirement plans.

I developed carpal tunnel while employed by the school system. They did not cover this unders workers comp.(although I sued them for it...) So, I've read under social security I have to work 5 years to re-establishment myself for disabilty under SS. Under TRS, if you do not claim disability after 5 years you become ineligible (if I'm read reading this correctly). So, I haven't worked for 2 years. Does this mean there will be a 2 year period in which I will not be eligible for disability under either program? This is if I find work today.

I think I need another operation on my right arm.

I am trying to get clarification on this question from the state of Ga. and TRS.

Thank you.

This is a complicated question. I would like to see your employee handbook before giving a final answer but my gut level response is that you should be eligible for both although there may be a setoff. Please call me at (770)427-8468 for a free consultation.I would like to help you if I can.
