Insurance Didnt Pay, Now Im Being Summonsed

I had A Very Minor Accident On July 7th 2004 In Atlanta. I Was Given A Traffic Violation. I Went To Court, Paid Fines, And Did Everything I Was Supposed To Do. Turned The Police Report Over To The Insurrance Company. They (Along With Me) Agree That The Man I Hit Was Out To Recieve As Much As Possible For A Small Amount Of Damage. They Assumed That He Was A Fraud, And Didnt Pay him. Now, Two Years Later, i recieve A Summons Saying That The Man Wants A Total $14,649.50 (Just under The limit For Small Claims Court)For Medical Bills And Compensation. he Claims He Had Neck And Back Injurys. The Man Was Not Hurt In My Eyes And In Fact he Told The Judge In Traffic Court That He Hurt His Ankle But Didnt Go To The Hospital Or A Doctor.... I Agree he Is A Fraud! What Should I Do?

File an answer in small claims court denying everything, or you'll end up with a default judgment against you.

You need to make sure that you answer the lawsuit within 30 days of service on you. Then, the magistrate court will set a trial date and you may present your case then along with any supporting documentation.
