`I was involved in a accident in which I was not at fault. The insurance company of the other party sent out an adjuster and sent a check for that amount. If I deposit the check into my account is that accepting their amount?

Yes. And if you were injured or otherwise disagree with the amount, it would be foolish to do anything before you call your lawyer.
