Legal Question in Insurance Law in Georgia

Settlement

I have an uninsured motorist claim (Rearended on May 13, 2005) whereby so far the medical bills are around eight thousand dollars for a concussion and foot/ankle soft tissue injury of which I am still receiving treatment for inflammation. No broken bones or lacerations.

They have offered around $6500.00 and say they do not pay twice the medical bills which I understand is the norm. They claim the settlement amount it is based on diagnosis. Should I not settle for less than twice the medical bills? They have paid all medical bills and car repairs to date.

They have been unsuccessful in finding the person who hit me even though I did give them the contact information and even told them to check with immigration since the guy was from Portugal. He was a subcontractor whose car insurance was not commercial but personal so his insurance denied the claim.

How much is this claim really worth for settlement? I have Progressive Insurance. Thank you.

Re: Settlement

You should retain an attorney to do the negotiation for you ASAP. If you are unrepresented, the insurance company will almost always try and get you to settle for less than is fair. This is especially true if you are still undergoing treatment.
