Legal Question in Intellectual Property in Georgia

I'm thinking of opening a business....rental gear, jumping bags, party supplies, etc. I have one costume that is a "elmo" look a like. I would like to advertise "elmo" parties and suppy ELMO for the day, elmo shape cake, and elmo party supplies. If I advertise (let "ELMO" look a like come to your party) I'm I breaking the copyright law.

Yes, that's breaking copyright law and you could be liable for enormous damages.

Almost certainly. You would need permission of the owner of the Elmo intellectual property, which I am sure would not be cheap.
