If the server is in Atlanta, my web page is for Spain and the IP law that is going to govern the Agreement is mexican, what jurisdiction will prevail?

Yes it would definitely depend on the claim(s), the parties, where they're located and probably some other factors. Like where is your business or you located? That is the law you want to govern your TOS and other site agreements. Your host company is pretty much insulated from suit. A well drafted contract will usually force them to sue you where you are located, which you didn't mention unless you are in Mexico. Buy why try to make Mexican law govern only IP? That doesn't make sense. Do you really want to go through the Mexican court system instead of arbitration or some other option?
