Legal Question in Employment Law in Georgia

I'm 51, recently laid off from a large corporation in GA. Company had demoted a Senior Manager to my job, eliminating his position. That person has now left the company. The company has posted the same position I had on the their website. Do I have any legal rights to be offered my old job back since it was termed "a workforce reduction" and I am over 50? Never had any HR issues.

You should reapply for the position. Thereafter, if you are denied, certain factors will exist to determine if you were discriminated against because of age.

You should review the EEOC's website regarding this issue. www.EEOC.gov.
