Legal Question in Employment Law in Georgia

Employer's Withdrawal of Bonus Check from Bank Account

Actually a two-part question. 1) Can an employer hire or fire you based on a personal credit report? 2) Can an employer, without any prior notification, withdrawal a bonus check from your personal bank account that was direct deposited there a week before? I didn't know there were direct withdrawals as well! Thanks for your help. Denise

Re: Employer's Withdrawal of Bonus Check from Bank Account

A credit report is not a "protected category" under anti discrimination laws. In MA you can be fired or hired on the basis of any reason that is not discriminatory.

No one has the right to withdraw from your bank account. If this,in fact, happened, your bank is liable to you. Also you can call the Wage and HOur Administration at the Attorney General's office to complain.
