at my job we have hand written schedules with total hours for the week posted. i have recently discoverd that my total hours say 40 for but they are only 39. this has been goin on since jan i am the only employee this is happend to. in yurn when i think i should have over time for that week i dont . is that legal

Your post is not clear. You tell us what the schedules says, but omit the most important detail - how many hours you actually worked.
