Legal Question in Employment Law in Georgia

A teacher's contract was not renewed for the upcoming year at a Georgia private school due to poor performance and failure to complete tasks as assigned. That teacher has several teacher editions (books) and CDs in their possession belonging to the school that would cost about $500 to replace. They have promised to mail the instructional materials back, but have not done so. Is it legal to take the cost of replacing the books out of the teacher's final paycheck? There is nothing specifically stated in the employee handbook about this situation. I need the materials returned quickly so that the new teacher can begin planning for the upcoming year.

No. You'd have to sue her.

Discuss this with the school's lawyer. No school should operate without having a lawyer on retainer.
