Legal Question in Landlord & Tenant Law in Georgia

I was approved for a house. I paid $40 for the application fee. The day I was to meet with the rental agent I received a call stating that the owner of the home changed their mind and wanted to rent to someone else. Is that legal? Am I do my application fee back since I was approved and they changed their mind?

Is it "legal" for a landlord to choose their renter? Of course it is. There is no right to rent a house (unless there is a lease, which you did not mention). As for the fee, you failed to state the terms of any agreement or paperwork you signed before you gave them the money. The terms of a refund should have been discussed and agreed upon prior to paying.
