How can I be evicted?

I am currently living in the house with the father of my 7 yr old son. I have lived there for 8 years now. He is saying that he wants me too move out but I dont have anywhere to go. What does he have to do to get me out of his house legally? Is there a such thing as being considered a guest and getting evicted as a guest?

It certainly is possible that a court may find that you have a landlord/tenent relationship, depending, in part, on whether or not the other person is the owner or sole lessor of the house (you did not provide this info, so I will not guess). If so, he may have to follow the dispossessory laws and provide the appropriate notices. That said, aside from any laws, you must look at the reality of the situation. If he is the sole owner of the property and really wants you out, it is only a matter of time. Work something out amicably so you have time to find a place - perhaps 4 to 6 weeks. It is probably not worth getting into a situation that escalates into lawyers, or even a domestic dispute where the police get involved. So many of these situations get there very quickly. A friendly conversation about a deadline will almost always get you further than telling him he will have to go to court to get you out. If he is unfriendly about it, it is simply another reason to try to get out, as your well-being (and his, and the child's) are more important than this temporary issue. I am not discounting the trouble and expense of you finding a place -- just placing it below personal safety, and long-term consequences.

You do not mention custody/support issues, but if that does come into play -- obviously, the child has to live somewhere and get support -- you may want to ask about that in another post in the appropriate topic. Do not unnecessarily place the child in the line of fire in an ugly dispute if it can be avoided. Winning a dispossessory dispute can be a meaningless victory in many sisutations. Good luck
