Legal Question in Landlord & Tenant Law in Georgia

Eviction & Late Fees

My landlord is attempting to evict us due to a check being returned. When he contacted me regarding the check, I told him I can come in and take care of it and pay any fees the bank charges for return checks. Well the check was written on the 1st and he contacted me 2 weeks thereafter. The rent is $1399 a month. He is not only charging me for the rent and return check now he says I owe him late fees of $720.00. What the GA law state a landlord can charge for late fees (max please)? I was fine with paying for the check and bank charge but the late fees being over 50% of my rent I don't agree. Is that legal? Please respond.

Re: Eviction & Late Fees

Your lease agreement will define the rate. However, Georgia usury law will also apply. The amount you're quoting appears too high after only 1 month.
