Legal Question in Landlord & Tenant Law in Georgia

Roommate bailed after 3 months

My 18 yr old daughter agreed to co-sign an apt lease with a 23 yr old girlfriend who's husband had filed for divorce. The girls agreed to share the rent and utilties, but it was the girlfriends idea to get the apartment. Three months later the girlfriend moved back in with her husband. I believe my daughter was hoodwinked into believing that the g/f would stay in the apt. The girlfriend kept a key but didn't live there. She didn't pay for any rent/utilities and told my daughter to find another roommate. My daughter's boyfriend tried to help pay the rent but three months before the lease was up my daughter told the landlord company that she couldn't afford the apartment anymore.

The Apt. complex sued my daughter for the remaining rent and now my daughter has a judgment for all of the unpaid rent.

How does she go about filing against the girlfriend in small claims court to get her roommate to pay her part of the rent?

I would need to see a copy of the lease to see who signed it and what the stipulations of the lease were. To file a small claim, all you need to do is to to the magistrate court and file the paperwork. They will help you with that.
