can i sue the person who was renting my mother's home when she died. the person was paying rent to me after her death but stopped and damaged the property. there is no copy of a lease

What authority do you have to sue on behalf of your mother's estate? What authority did you have to collect the rent? Even if you or someone else can sue, what are the chances of collecting anything to make it worth the time and legal fees?
