Legal Question in Legal Ethics in Georgia

Are all 501(c)3 entities subject to the Sunshine Law? Our local animal advocate organization has this status and I am wondering if we must abide by the same laws regarding meetings as other groups, such as school boards?

Georgia's Open Meetings Law and the Open Records Law apply to all

entities which are an �agency� of the state or local government in Georgia.

Almost no 501 c3 entities fit that.

However, in addition, the Public Records Law applies to associations whose members

are themselves �agencies� if the association itself receives a substantial part

of its budget from state or local governments. So if you accept government funds, you may be covered.

No 501c3 agency should operate without legal counsel, and this is a question for them.
