Legal Question in Legal Ethics in Georgia

My wife and I are buying a house with another couple who we share our lives with, and in the process of working with a homebuilder's representative, we explained our living arrangements in confidence during the course of business for designing our home. Yesterday, a coworker who lives in the neighborhood we are building in informed me that the builder's representative has been warning people that there are "swingers" moving in, and identified the lot we are building on, advising people to watch out for us. We are not swingers, nor do people need to be 'warned' about us. My question is: Is it a violation of privacy for a real estate agent to discuss my private information, including sexual preference, that she gained knowledge of through the course of business with other clients or potential clients without my permission?

You have no general expectation of privacy with another party's representative. Generally, information ceases to be "private" when you discuss it with others. There are very few situations in which information is legally protected, including lawyer/client, doctor/patient, etc. Real estate agent or builder don't fall into those categories.
