Legal Question in Medical Malpractice in Georgia

hospital admits negligence

My son who is 27 recently injured his left arm. He fell and dislocated hiw left elbow (and later it was found that he also dislocated his left wrist as well). He was misdiagnosed while at the ER and later he required surgery to his wrist due to the dislocation in his wrist that was not treated or acknowleged. This resulted in 2 surgerys and 2 Dr's costs as well a P.T bills. They want us to suggest a settlement amount , & are willing to pay all medical costs. What is an approperate amount to settle with the hosiptal? We have not involved an attorney up to now.

As a nurse-attorney, I strongly suggest that you hire an attorney to represent you. You should avoid any further discussion with the hospital, its representatives, its attorneys or malpractice insurance representatives until you select legal counsel. There's no way anyone could suggest a number without seeing the medical records. While there's also no way anyone here can, without details, assess the strength of your case, odds are that any settlement offered to you without counsel will be less than a settlement offered with counsel.

While the amount likely will not be huge, you may well shortchange yourself proceeding without counsel.

Bear in mind also that should you let the statute of limitations expire, you will end up with zero, so time is very critical.

You need to see an attorney who regularly handles medical malpractice cases -- not just a lawyer who claims to do a dozen areas of law deoending on who they are talking to. All med mal lawyers have current medical professionals on call, and the opinion of a physician, not a nurse, is a necessity if you have a potentially valid case.
