Legal Question in Medical Malpractice in Georgia

Lauren

My daughter died from an aneurysm, three days after she suffered from a head injury from riding a faulty motor scooter. My question pertains to an article I read stating five year statue of limitation on a Medical Malpractice law in which the date starts on when the injury was found/diagnosed. I do not know law, but it seems to me that there is a two year and/or three year/ five year statue of limitation. This depends on the injury and the date. Is there more than one statue of limitation? Do you need more info.?

Re: Lauren

The five year statute would apply to any claim belonging to the child if she survived the injury. My view is that the two year statute applies from the information you have related for a wrongful death case.
