Legal Question in Medical Malpractice in Georgia

My mom passed away Sunday from breast cancer the 2nd doc that she had when she was in remission for two years didn't give her treatment and refused pain meds when the cancer came back she lived in Georgia i contacted a law firm to file a malpractice suit i also stated that after she refused we seek'd a 2'nd opinion within that months time the new docs stated that the cancer had spread to the left side of her pelvic and to her brain please tell me why the first doc didn't know that or knew and just refused to give us that information even when we received a copy of the records for the new doc there wasn't anything in there that the cancer had metastasized to other areas here now this firm is telling me that since she came home to die and was on hospice a malpractice suit can not be filled therefore this negligent doc lives on to terrorized and kill someone else loved one because she feels that there not in enough pain to prescribed pain meds or even treat what is the deal with that.
