Legal Question in Personal Injury in Georgia

My 5-year old son was pushed off a playground ladder and broke his arm badly while on a school field trip requiring surgery and two screws in his elbow who should be held responsible, clearly when I got to the scene there was not enough teacher to student ratio because the kids were crowded on the platform;pushing and shoving each other.Mind you that the playground equipment they were playing on has a sign there that clearly states that the platform because of it's height is rated for 12 year olds and my son is in Kindergarten.How do I go about handling this I just want to know how this happened because he said he was pushed by another student.

You spend more time trying to pin liability than actually providing basic facts. Who pushed, and what specific evidence do you have? Did your child push, or do anything else? What was the "platform" and "ladder?" If you just want to know what happened, why are you asking people here who can't possibly know? Have you asked the school principal, or others at school?

When I was in kindergarten, I fell off a very high ladder on a slide, and broke my arm in 2 places. I swore someone pushed me, as unlikely as that was. That was way before the days when every injury meant lawsuits. Sometimes accidents just happen on playgrounds and active kids get hurt. That does not always mean a check from someone else, even where there is a legitimate issues of making sure the kids are not in a place where getting injured is a little more likely.
