Accident Claim Denied

I was hit by a drunk driver on Dec 8,1998 while riding my bicycle. I made many errors at the scene because the driver made a threatning comment so I allowed him to go home and I waited til I got home to call police and go to er. Then I listened to the Ins Co when they told me I didnt need an attorney. The police reports drawing was not clear and now right before the statute of lim are up Allstate is saying they aren't at fault and using the police drawing as the reason. It was written on their copy that it was wrong and the police officer said he would explain it but they say they can't reach the officer. I have spoken to him several times. The man who hit me has disappeared and is no longer insured by that co. I have waited too long and no attorney wants the case. I have approx. $20,000 in medical bills. I am going to sue in civil court on my own but do not know how to do it since I don't know where the man is. Any help would be appreciated as i only have til the 8th of Dec. to file. Thank-you
